You can utilise VIP Delivery Pass immediately after purchase. i.e. to purchase items from the Site on the same day you purchase the VIP Delivery Pass. Our Terms of Sale apply to the purchase of the VIP Delivery Pass in addition to these terms and conditions. Subscribing to and using VIP Delivery Pass You need to be a registered Missguided customer to subscribe to VIP Delivery Pass. You must be logged into your Missguided account to use VIP Delivery Pass. VIP Delivery Pass is valid from 12 months from the day you sign up (Subscription Term). Your use of VIP Delivery Pass is subject to these terms and conditions. Your subscription is locked to the US. You cant use VIP Delivery Pass in another country (including without limitation any other Missguided branded website for a different geographical location). The delivery address must be a US post code and not a restricted post code defined within the Delivery Restrictions section referenced below. Cancellation You can cancel VIP Delivery Pass within 14 days of placing your order (Cancellation Period). A full refund of your VIP Delivery Pass will be given if you have not made any eligible purchases using VIP Delivery Pass. Once an eligible purchase has been made, your subscription cannot be cancelled. For the avoidance of doubt, an eligible purchase means any use of the VIP Delivery Pass in conjunction with an order during the Cancellation Period. There is no minimum spend required to use VIP Delivery Pass. We cant be held liable for any parcels that are lost or stolen as a result of any specific delivery instructions left for the delivery partner. Cut-off times Orders must be made within the delivery timescales set out in checkout. Before you finalise your order, well give you estimated delivery times and dates (and the delivery options available) depending on the order time and delivery address. Delays We try our hardest to ensure delivery by the delivery timescale stated above. We and our delivery service providers may be unable to do so by reason of circumstances beyond our/their reasonable control, including without limitation extreme weather conditions, adverse traffic conditions, failures of vehicles, postal/carrier delays, logistics or an inability to access your property. By proceeding with purchase of the VIP Delivery Pass you also acknowledge and agree that given the nature of the VIP Delivery Pass, the delivery restrictions may change from time to time during the duration of the Subscription Term and you are advised to review the delivery restrictions periodically and at each time you wish to make a purchase to ensure that you are clear on the applicable cut off times and post code restrictions at the relevant time. Expiry of Subscription At the end of the Subscription Term the VIP Delivery Pass will end and you will need to pay for delivery services in the normal course i.e. you will be charged for the VIP Delivery Pass or any other delivery option you choose. VIP Delivery Pass is strictly for personal use only and must not be used for business, re-sale or wholesale purposes. Fair use You can order as many times as you want when using VIP Delivery Pass but this is subject to fair use. If we suspect any fraudulent activity or notice any unusual pattern of returns, e.g. we suspect someone is actually wearing their purchases and then returning them or the items returned don't match what you ordered then we reserve the right to suspend your account/VIP Delivery Pass pending further investigation and, ultimately, deactivate your account depending on the outcome of such investigations. Furthermore, we reserve the right to take legal action against you in relation to any suspected fraudulent activity. Termination and suspension We may terminate a VIP Delivery Pass at any time and you will be given a prorated refund based on the number of full months left in your Subscription Term. A refund will not be given if we suspect or discover (in our sole discretion) that use of VIP Delivery Pass: has been in breach of these terms and conditions; has been for business, re-sale or wholesale purposes, or for any purpose other than can be reasonably expected of someone using the service for personal use; and/or involves fraud or misuse or is otherwise detrimental to Missguideds interests. If we suspect or discover such conduct, we may suspend or terminate a VIP Delivery Pass, refuse or cancel order(s) or close or freeze the Missguided customer account (and associated accounts) (even if we have previously confirmed an order). Well try to contact you if this happens, but if this happens to you and you think weve made a mistake, get in touch with Customer Care and theyll be happy to speak to you about it. If we suspect or discover that a VIP Delivery Pass has been used in breach of these terms and conditions, we have the right to recoup all our direct delivery costs and losses from the account holder. General You cannot transfer or exchange the VIP Delivery Pass for any other purpose, amount, gift, items, money, vouchers or other form of compensation. We reserve the right to accept or refuse purchase of VIP Delivery Pass and to change any terms and conditions at our discretion. You acknowledge and agree, that we may refuse, suspend or cancel the VIP Delivery Pass at any time if you breach these terms and conditions, our Terms of Sale and/or any other terms and conditions and policies referenced therein). To the fullest extent permitted by law we exclude any and all liability for any loss, damage or injury occurring to you or any third party arising from using VIP Delivery Pass. If any provision or part-provision of these terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable.
